En el caso de un empleado que al 31/12/2007 no cumple con el tiempo mínimo de trabajo que se requiere para gozar de 14 días de la licencia por vacaciones (ingresó el 01/08/2007), ¿se puede acumular a esa antigüedad el plazo que sigue hasta la fecha en que va a gozar las vacaciones (15/03/2008) y así superar los 6 meses de antigüedad y gozar de 14 días de licencia? ¿Es a opción del empleado o del empleador?
No se puede acumular tiempo posterior al 31 de diciembre. Siempre se debe tomar la antigüedad al 31 de diciembre de cada año. En el caso planteado, al trabajador le corresponde un (1) día de vacaciones por cada veinte (20) días efectivamente trabajados.
